New rules for property and car transactions are already in force in Bulgaria, after the adopted amendments to the tax and Social Security Procedure Code – TSSPK, which are in force as of 03.05.2024.
The amendments provide for the abolition of the declarations of lack of outstanding public obligations, with which citizens are obliged to obtain and present them when transferring real estate and motor vehicles. The verification of such obligations will now be carried out by the notary by electronic means or, in a limited number of cases, by the judge of registration. Under these changes, notaries and registry judges will now be jointly and severally liable for the obligations due by citizens in case of non-compliance with the requirements of the law.
Replacing the submission of archaic, millions in number of sworn declarations of citizens annually with effective real-time verification of the existence of outstanding, enforceable public obligations will significantly increase the collection of revenue in the budget, the Chamber of Notaries explains.

Notaries will have remote access to the information systems of the NRA, through which they will receive information through application software interfaces, the chamber added. It will be realized jointly by the Directorate “Information Systems and e-government” and the experts of the notary Chamber.
The electronic exchange of information is an innovative solution for electronic Administrative Procedure, which increases the role and responsibility of the notary in the transactions with real estate and motor vehicles.
If a notary confesses a deal to a person with obligations to the state – he will be personally responsible.
“These changes really put a strain on our work, as the notary has to effectively check for the existence of public obligations subject to public performance – not as the parties have so far submitted declarations. We are personally responsible. This means that if a fine for a traffic violation is not paid, then the notary has to pay it out of his own pocket,” commented Dimitar Tanev, chairman of the notary chamber.
Hastily made changes to the tax and Social Security Procedure Code 10 days ago also caused turmoil in the sector. The redacted text also requires a re-examination by a registry judge. “I am worried that there will be a delay in the deal because, according to my information, the registration judges are still not ready with the relevant equipment, computers, they do not have electronic signatures and this could cause a delay,” added Dimitar Tanev.
The specialists advise to make inquiries about obligations earlier than the day of the transaction, and this is possible through the NRA website.
